non payment
i have tiled and grouted a porcelain bathroom walls and floor , bathroom company were in a hurry to get it finished and fitted all the sanatry wear and fittings ,i posted my invoice to them only for them to tell me there were some issues with some of the tiles and they are not going to pay , can anyone tell me, must they give me two chances to put the work right they say is wrong before payment is made ,

Hi kev.
Yes, they must allow you to put right said faults at your costs.

Re: non payment
They have to give you the opportunity to put the work they are not happy with right. They are in the wrong to just say they are not going to pay.
-
-
Re: non payment
Did they actually say what the issues were, or was it a straightforward 'we're not paying you'? They must give you the opportunity to rectify any problems at your cost as Dave says.

Re: non payment
So they saw the chipped tiles before you fixed them, or they were fixed and then they commented not to worry, knowing they would be behind a radiator?

Re: non payment
hi kev,1st of all you must contact the bathroom company
i would call them 1st and advise them that you have to be notified 1st if they want any tiles changed as it was you who did the job, they cannot just claim at the end tiles werent up to scratch and pay you nothing and sat goodbye
if you dont get anywhere verbally with them, send a recorded delivery letter asking for payment within 7 days and if this is not met court action will follow
if no response open a small claim...i think it costa about 60 pounds and pursue them for full payment
hopefully it wont come to that but they have to give you the sub contractor the chance to rectify anything they cant just say your not getting paid and we have fixed it.
good luck

Re: non payment
So they are looking to get out of paying you, if they were fully aware of the location, behind radiator. Did you say that they were purposely placed there because it would be behind a radiator and not seen, or did they tell you to put those tiles there?

Re: non payment
no had to put the tiles on reverse as the wall was on a angle , they knew they were a little chipped but they said it would not matter as the tiles were behind a radiator

-
Re: non payment
So no other problems other than tiles behind radiator that either they or the customer has brought to your attention?
-
-
Re: non payment
customer has probably pulled them up on the chipped tiles and now they're passing the buck.

Re: non payment
They still need to give the fixer the opportunity to correct the mistakes, in my opinion they are just looking for a reason not to pay. Not a nice feeling when someone tries to rip you off for no good reason.

Re: non payment
i agree op must be given opportunity to rectify

Re: non payment
can you get a meeting with the customer and the bath company, to sort this out, far to many companies try this on , dont back down
-
-
Re: non payment
Tell you will take the lot down if they dont pay
That will get them moving
GOOD LUCK
